2. Scope
These terms govern the distance selling of food products (extra virgin olive oil and condiments) through www.tenutecatena.com, under Italian Legislative Decree 206/2005 (the Consumer Code) and Legislative Decree 70/2003, which implement the relevant European directives in Italy.
3. Buyers resident in other EU countries
The contract is governed by Italian law. If you buy as a consumer resident in another EU Member State, this choice does not deprive you of the protection afforded by the mandatory provisions of the law of your country of habitual residence (Article 6 of Regulation (EU) 593/2008, «Rome I»).
4. Prices
Prices are in Euro and include VAT. Shipping costs are shown separately and calculated at checkout before you confirm the order. No customs duties apply to shipments within the European Union. Tenute Catena may change prices at any time, with no retroactive effect on orders already confirmed.
5. Orders
An order is an offer to buy. The contract is concluded when the seller sends the order confirmation by email. We reserve the right to decline orders where a product is unavailable or the information given is incorrect or incomplete.
6. Payment
We accept the payment methods shown at checkout. Payment is due before dispatch. Card details never pass through our servers and are not stored by us: they are handled directly by the payment service provider.
7. Shipping and delivery
Products are dispatched within 1-2 working days. For times, costs and destinations see Shipping and delivery. For consumers, the risk of loss or damage passes when the consumer, or a third party designated by them, takes physical possession of the goods.
8. Right of withdrawal
Consumers have the right to withdraw within 14 days of receiving the goods, without giving any reason. Withdrawal applies to all products returned still sealed; it does not apply to containers opened after delivery, for reasons of hygiene and health protection (Article 59(1)(e) of the Italian Consumer Code, implementing Article 16(e) of Directive 2011/83/EU). Return costs are borne by the consumer; the refund, including standard delivery costs, is made within 14 days. 9. Legal guarantee of conformity
All products carry the 24-month legal guarantee of conformity under Articles 128 ff. of the Italian Consumer Code. If a product is defective or damaged in transit, tell us within 24 hours of delivery, attaching photographs, at info@tenutecatena.com.
10. Food information
The mandatory food information required by Regulation (EU) 1169/2011 is shown on each product page and is available before the purchase is concluded.
11. Privacy
Personal data is processed in accordance with our Privacy Policy, under the GDPR (Regulation (EU) 2016/679).
12. Dispute resolution
The court of Salerno has jurisdiction, without prejudice to the consumer’s mandatory place of jurisdiction. The European online dispute resolution platform is also available: ec.europa.eu/consumers/odr.
